These Terms of Service (“Terms”) govern your access to and use of Tute Academy’s website, digital platforms, and educational services. By enrolling a student or accessing our services, you agree to be bound by these Terms.

Services Overview

Tute Academy is a virtual educational platform providing:

Interactive Learning: Live online Nigerian language lessons.
On-Demand Content: Pre-recorded language learning modules and digital resources.
Curriculum-Based Instruction: Structured education for children (ages 5–16) and adults (18+).

All services are delivered via Tute Academy’s approved LMS platform

Eligibility & Enrolment

Minors: Learners aged 5–16 MUST be enrolled by a parent or legal guardian. By enrolling a minor, the parent/guardian assumes full responsibility for the minor’s compliance with these Terms.
Adults: Learners aged 18+ may enrol independently.
Tutors: All instructors must successfully complete Tute Academy’s vetting process, including background checks and safeguarding training, prior to delivering services.

Account Responsibilities

To maintain a secure learning environment, users agree to:

Provide accurate, current, and complete registration information.
Maintain the confidentiality of account credentials and notify us immediately of any unauthorized access.
Supervision: Parents/guardians are responsible for ensuring that child learners have a safe, quiet, and appropriate environment for virtual lessons.

Payments, Subscriptions & Cancellations

Fees: Service fees are determined by your selected plan (1-on-1, Group, or Pre- recorded).
Billing: Subscriptions are billed in advance. Unless otherwise stated, all payments made to Tute Academy are NON-REFUNDABLE once classes have commenced, as resources and tutor time are allocated in advance. However, where a service cannot be delivered due to reasons solely attributable to the Academy, an appropriate refund or class credit may be issued at our discretion. Refund requests must be submitted in writing and will be reviewed on a case-by-case basis. No refunds are provided for missed classes or for partially used subscriptions. Tute Academy reserves the right to apply refunds as credits toward future classes where applicable
Attendance Policy: Tute Academy requires at least 12 hours’ notice for session cancellations. Missed sessions without prior notice ("No-Shows") are non-refundable and will not be credited.
Scheduling Missed Classes

Students are entitled only to the number of classes paid for within each billing cycle. Consistent attendance is required to complete levels within the expected timeframe. Where a student is unable to attend a scheduled class due to valid reasons, which are strictly limited to:

Medical emergencies,
Documented school or examination conflicts,
Platform-related issues attributable to Tute Academy.

Notice is provided at least two (2) hours before the scheduled class time, one (1) make- up or carryover class per billing cycle may be granted, subject to tutor availability. Any approved carryover class must be used within thirty (30) days, either within the same or immediately following billing cycle. Additional missed classes beyond this allowance are forfeited and will not be refunded or carried forward.

Class Conduct & Safeguarding

Recording: To ensure quality assurance and child safety, sessions may be recorded. By using our services, you consent to such recordings for internal safeguarding purposes.
Behaviour: We maintain a zero-tolerance policy for disruptive, disrespectful, or inappropriate behaviour. Tute Academy reserves the right to remove any learner from a session who compromises the learning environment.

Instructor Professionalism

All Tute Academy tutors are bound by a strict Code of Conduct. Tutors must:

Adhere to all safeguarding and online safety protocols.
Maintain strictly professional boundaries. Off-platform communication between tutors and learners/parents is strictly prohibited.
Violation of these standards by a tutor will result in immediate termination of their contract.

Intellectual Property

All curriculum content, lesson materials, video recordings, and branding (logos, designs) are the exclusive intellectual property of Tute Academy.

Limited License: Users are granted a non-transferable license to access materials for personal educational use only.
Restrictions: You may not record, copy, distribute, or commercially exploit any Tute Academy content without express written consent.

Platform Limitations

While we strive for 100% uptime, Tute Academy is not liable for:

Temporary service outages for maintenance.
Technical failures of third-party platforms (LMS providers).
Connectivity issues arising from the user’s local internet service or hardware.

Termination

Tute Academy reserves the right to suspend or terminate access to services without a refund in the event of:

A material breach of these Terms.
Failure to pay subscription fees.
Conduct that threatens the safety or wellbeing of our community.

Limitation of Liability

To the maximum extent permitted by law, Tute Academy’s total liability for any claim arising from our services is limited to the amount paid by the user during the billing period in which the claim arose.

Governing Law

These Terms are governed by and construed in accordance with the laws of The United States of America
